Dowry Death Investigation

Legal Basis:

 * IPC Section 498-A (Cruelty by husband/relatives) – Now BNS Section 85

 * IPC Section 406 (Criminal breach of trust) – Now BNS Section 336

 * Dowry Prohibition Act, 1961

 * Punishment: 7-10 years imprisonment + fine

 * Category: Non-bailable, Cognizable

 * Mandatory Forensic: YES (death involved)

INVESTIGATION CHECKLIST:
STEP 1: RECEIVE COMPLAINT (BNSS Section 173)

 * Register FIR immediately when death reported

 * Record date, time, and place of death

 * Record name and age of victim (wife)

 * Record name and details of husband/in-laws

 * Record how death discovered

 * Record circumstances of death

 * Note if family trying to hide death

STEP 2: IMMEDIATE POLICE ACTION

 * Rush to location immediately

 * Secure the body and prevent removal

 * Prevent destruction of evidence

 * Preserve all items at scene

 * Prevent forced cremation/burial

 * Arrest husband/family members if needed

 * Collect all dowry-related documents

STEP 3: MEDICAL EXAMINATION (BNSS Section 176)

MANDATORY forensic autopsy:

 * Arrange post-mortem examination immediately

 * Medical expert must perform autopsy

 * Autopsy must examine for:

   * Burn injuries (if dowry death by fire)

   * Poisoning traces in body

   * Blunt force injuries

   * Signs of torture/abuse

   * Abdominal injuries

   * Presence of accelerants (if burn case)

 * Medical expert must prepare detailed autopsy report

 * Collect biological samples for toxicology

 * Collect evidence from body

STEP 4: CRIME SCENE EXAMINATION (BNSS Section 176)

If death from burns:

 * Call forensic expert (MANDATORY)

 * Video record entire scene

 * Photograph body in position found

 * Photograph burn patterns

 * Examine for accelerants (petrol, kerosene, etc.)

 * Collect samples of burned material

 * Examine clothing

 * Check for fire source

 * Collect ash and residue samples

 * Map burn patterns to determine if accidental or intentional

STEP 5: COLLECT DOWRY EVIDENCE

Collect all dowry-related documents:

 * Marriage invitation cards (mention dowry/gifts)

 * Dowry list/agreement

 * Gift receipts and bills

 * Photographs taken during wedding

 * Jewelry/items received as dowry

 * Money transactions

 * Witnesses to dowry demand

 * Any threats or pressure notes

STEP 6: WITNESS STATEMENTS (BNSS Section 180)

Record statements of:

 * Family members who found body

 * Neighbors regarding violence/abuse

 * Wife’s parents (dowry demanded?)

 * Wife’s friends/relatives

 * Servants/household help

 * Police who arrived at scene

 * Medical personnel

 * Anyone aware of marital discord

STEP 7: ARREST AND INTERROGATION

When husband/family arrested:

 * Medical examination for injuries

 * Record statement about circumstances of death

 * Question about dowry demands

 * Question about recent quarrels

 * Question about insurance policies

 * Question about life after marriage

 * Question about injuries to victim

 * Question about threats received

STEP 8: INVESTIGATION ITEMS TO CHECK

 * Insurance Policies: Life insurance on victim taken recently?

 * Financial Motive: Any debts or money problems?

 * Medical Records: Was victim pregnant? Any health issues?

 * Mobile Records: Calls to other women? Threats sent?

 * Bank Records: Recent large withdrawals or transfers?

 * Relationship Status: Extramarital affair? Other women?

 * Family Disputes: Property/inheritance issues?

STEP 9: COLLECT EVIDENCE FROM HOUSE

Search the house and seize:

 * All items used as weapons

 * Accelerants (petrol, kerosene, matches, lighters)

 * Letters/notes threatening victim

 * Photographs and videos

 * Medical prescriptions

 * Insurance papers

 * Dowry documentation

 * Victim’s personal belongings

 * Any evidence of other crimes

STEP 10: FORENSIC ANALYSIS

Submit to FSL:

 * Samples from body for toxicology

 * Samples for ballistics (if shooting)

 * Accelerant samples (if burn case)

 * Biological samples for DNA

 * Comparison samples from suspect

 * Request priority analysis

STEP 11: INVESTIGATION DIARY (BNSS Section 192)

Maintain detailed record:

 * Date/time of discovery

 * Condition of body found

 * All evidence collected

 * All statements recorded

 * All forensic findings

 * Timeline of events

 * Findings of investigation

STEP 12: CONSULTATION WITH MAGISTRATE

 * Inform Magistrate of death

 * Seek Magistrate’s order for custodial interrogation if needed

 * Keep Magistrate updated on progress

 * Show evidence collected

 * Get Magistrate’s approval for arrests

STEP 13: CHARGESHEET (BNSS Section 193)

 * Complete investigation quickly

 * Prepare detailed chargesheet

 * Include autopsy report

 * Include forensic reports

 * Include all witness statements

 * Include all evidence collected

 * Include dowry documents

 * Submit within 60 days
