Public Interest Litigation to Supreme Court of India
To the Honourable Chief Justice and Judges of the Supreme Court of India,

This petition seeks the kind intervention of this esteemed Court to issue a writ of mandamus directing the Union Government of India and the competent authorities of all States and Union Territories to make American Sign Language (ASL) a compulsory subject in the curriculum of all schools for the deaf across India, alongside retaining Indian Sign Language (ISL) as well.
Grounds for the Petition:
Right to Education and Language Parity: The Constitution of India, under Article 21, guarantees the fundamental right to education. This right extends to students with disabilities, including those who are deaf and hard of hearing. The Right of Persons with Disabilities Act, 2016, further emphasizes the need for inclusive education and equal access to communication for persons with disabilities. However, the current education system for the deaf in India primarily focuses on ISL, neglecting the significant benefits of ASL.
Global Communication and Employment Opportunities: ASL is the fourth most common language in the United States and is widely used in many other countries as well. Proficiency in ASL would equip deaf students in India with the ability to communicate with a larger global community, opening up avenues for international education, employment, and cultural exchange. This would significantly enhance their social and economic inclusion.
Technological Advancement and Knowledge Access: A vast majority of educational resources, including online courses, webinars, and technical tutorials, are available in ASL. Access to these resources would equip deaf students with cutting-edge knowledge and skills, preparing them for success in various fields. Currently, the limited availability of such resources in ISL restricts their access to this vital information.
Strengthening Deaf Identity and Bilingualism: While retaining ISL is crucial for preserving India’s cultural heritage and deaf identity, including ASL would not diminish its importance. Instead, it would promote bilingualism among deaf students, offering them greater flexibility and communication options. This bilingual approach is increasingly recognized as beneficial for cognitive development and academic achievement among deaf individuals.
Feasibility and Implementation: Several successful models of bilingual deaf education programs incorporating ASL alongside local sign languages exist worldwide. Implementing such programs in India would require collaboration between the government, educational institutions, and the deaf community. With proper planning and resource allocation, integrating ASL into the curriculum is entirely feasible.

In light of the aforementioned grounds, we humbly pray that this Honourable Court may be pleased to:
Issue a writ of mandamus directing the Union Government of India and the competent authorities of all States and Union Territories to make ASL a compulsory subject in the curriculum of all schools for the deaf across India, alongside retaining ISL.
Order the development and implementation of bilingual education programs incorporating ASL and ISL for the deaf in India.
Allocate necessary resources and provide training for teachers and educators to effectively implement bilingual education programs.
We believe that including ASL in the curriculum would be a significant step towards ensuring equal access to education, communication, and opportunities for deaf students in India. We, therefore, place our sincere faith in the wisdom and justice of this Honourable Court for a favourable consideration of this petition.
