Kidnapping Investigation

Legal Basis:

 * IPC Section 363 (Kidnapping) – Now BNS Section 137

 * IPC Section 364 (Kidnapping for ransom) – Now BNS Section 138

 * Punishment: 7-10 years imprisonment

 * Category: Non-bailable, Cognizable

 * Mandatory Forensic: YES (7+ years)

INVESTIGATION CHECKLIST:

STEP 1: RECEIVE COMPLAINT (BNSS Section 173)

 * Register FIR immediately (time is critical)

 * Record exact date and time of kidnapping

 * Record details of kidnapped person (age, description)

 * Note name, address, contact of complainant

 * Document if ransom demand made

 * Document if any threat received

STEP 2: IMMEDIATE POLICE ACTION

 * Alert police stations in all nearby areas

 * Issue All-India Alert through CCTNS

 * Inform border police if interstate kidnapping

 * Alert Railway/Airport authorities

 * Inform highways patrol

 * Check hospitals (in case of harm to victim)

STEP 3: GATHERING INITIAL INFORMATION

 * Interview family members thoroughly

 * Check if victim has enemies

 * Check for business rivalries/disputes

 * Check victim’s financial status

 * Check victim’s recent movements

 * Obtain photograph of kidnapped person

STEP 4: RANSOM COMMUNICATION

If ransom demand received:

 * Do NOT rush to comply

 * Record exact ransom demand (amount, method)

 * Record all communications (calls, messages, emails, letters)

 * Trace mobile number (if phone call)

 * Keep family informed but controlled

 * Advise family NOT to pay ransom immediately

STEP 5: FORENSIC EXAMINATION (BNSS Section 176)

If crime scene identified:

 * Call forensic expert (MANDATORY)

 * Video record entire scene

 * Collect evidence:

   * Blood samples

   * Hair samples

   * Fingerprints

   * Footprints

   * Any items left by kidnappers

 * Take photographs from all angles

 * Prepare crime scene sketch

STEP 6: VEHICLE EXAMINATION (if used)

If vehicle involved:

 * Examine vehicle at crime scene

 * Collect fingerprints from steering, handles

 * Collect hair/fiber samples

 * Take photographs from all angles

 * Video record vehicle exterior and interior

 * Check for blood stains

 * Collect any abandoned items

STEP 7: WITNESS STATEMENTS (BNSS Section 180)

Record statements of:

 * Family members

 * Neighbors who saw anything

 * Friends of victim

 * School/office colleagues

 * People at abduction site

 * Anyone with information

STEP 8: INVESTIGATION DIARY (BNSS Section 192)

Maintain detailed investigation diary including:

 * All actions taken and dates/times

 * All evidence collected

 * All statements recorded

 * All communications received

 * All suspicions and reasons

 * All visits to crime scene/related locations

STEP 9: SUSPECT IDENTIFICATION

 * Check criminal records

 * Check known criminals in area

 * Check gang activities

 * Check for similar cases in past

 * Prepare sketches of suspects

 * Issue lookout notice

STEP 10: WHEN VICTIM LOCATED/RESCUED

 * Immediately rescue victim safely

 * Medical examination of victim

 * Record victim’s statement

 * Examine victim for injuries/trauma

 * Collect evidence from victim’s clothing/body

 * Preserve all evidence from rescue location

STEP 11: ARREST OF SUSPECT

When suspect arrested:

 * Search suspect’s house with warrant

 * Seize ransom money (if recovered)

 * Medical examination of suspect

 * Collect DNA samples

 * Record statement of suspect

 * Look for victim’s belongings in suspect’s possession

STEP 12: EVIDENCE SUBMISSION

Submit to FSL:

 * All physical evidence collected

 * Vehicle evidence (if any)

 * Photographs and videos

 * Request DNA analysis

 * Request fingerprint comparison

STEP 13: CHARGESHEET (BNSS Section 193)

 * Complete investigation quickly

 * Prepare detailed chargesheet

 * Include all evidence with chain of custody

 * Submit within 60 days
